Lawsuit accuses Shaya Boymelgreen of moving lender’s cut to Miami Beach project



Shaya Boymelgreen sold 100 vacant acres for $12.6 million in unincorporated southwest Miami-Dade County last year, but he failed to pay a loan guarantor $2.4 million from the profits, according to a recent lawsuit.

Miami-based lawyer David Efron and his entity Norfe Krome sued Boymelgreen and his affiliate Deaderick SSB for breach of oral contract, negligent misrepresentation and unjust enrichment. 

The complaint, filed in Miami-Dade Circuit Court last month, alleges Boymelgreen placed $6.8 million in profits from the land sale into an unrelated project in Miami Beach without paying a 30 percent cut allegedly owed to Efron’s entity.

Boymelgreen “intentionally” didn’t inform Efron of the closing date, “in order to avoid paying” Efron’s share at closing, said Herman J. Russomanno III, Efron’s lawyer. 

Boymelgreen did not respond to requests for comment. 

Efron, who is the longtime boyfriend of Miami-Dade State Attorney Katherine Fernandez-Rundle, guaranteed and collateralized a loan for Boymelgreen’s purchase of the 100 acres in exchange for 30 percent of the profits once Boymelgreen resold the land, Russomanno said. 

Boymelgreen bought the vacant land from Efron in two purchases in 2019 and 2022 for a combined $5.8 million, records show. Boymelgreen’s entity obtained a $5 million loan in 2022 secured by the 100 acres and guaranteed by Efron’s entity. 

Boymelgreen sold the land for $12.6 million and paid off the loan in August, records show. Efron alleges Boymelgreen was supposed to pay him $2.4 million, representing a 30 percent share of the $6.8 million profit. 

Instead, Boymelgreen allegedly placed all of the profits into another affiliate, JP Roosevelt, the development entity for 42 Pine, a planned eight-story, 50-unit condo project under construction in Miami Beach. 

Boymelgreen listed a six-story office building next door to the 42 Pine site in July with an asking price of $19.9 million.
