City responds to North Miami Seashore Mayor Anthony DeFillipo in counter claim

MIAMI – On Friday night, CBS4 acquired documents of the city of North Miami Beach’s response to the mayor’s lawsuit from it.

The city seeks to dismiss Mayor Anthony DeFillipo’s criticism to alter charter by-legislation to enable the town commission meeting to maintain a quorum with four commissioners. Current town regulations require at the very least 5 existing commissioners to conduct formal small business.  

The city also filed a counterclaim from DeFillipo.  In portion, it asks the courtroom for an “injunction prohibiting DeFillipo from symbolizing, expressing, or implying that he is the City’s lively, sitting down mayor and making an attempt to, purporting to, or essentially training any of the legal rights, obligations, or authority that is reserved for the holder of the place of work of City’s active, sitting down mayor.”  

In the filings, the town offers proof hard the mayor’s most important residency in North Miami Seaside.  The city constitution states elected officials must “normally be and continue to be bona fide citizens” of North Miami Seashore.  If not, it phone calls for immediately vacating of the seat.

The lawsuit alleges DeFillipo does not have a major residence in North Miami Seashore but in Davie as an alternative.
